CONTEST RULES

"Gaming Children's Day"

§1
General provisions

1. These regulations (hereinafter referred to as the "Regulations") specify the terms and conditions for conducting the "Gaming Children's Day" competition (hereinafter referred to as the "Competition"), as well as the selection of the winners of the Competition.

(2) The Organizer of the Contest is Modecom Polska Sp. z o.o., (hereinafter: "Organizer"). The Contest takes place on the territory of the Republic of Poland.

(3) The Contest participant confirms that he/she has read the Contest Regulations and agrees and accepts the terms of the Regulations by entering the Contest.

(4) The Organizer declares that the Contest is not a game or game of chance, the result of which depends on chance within the meaning of Article 2 of the Act of November 19, 2009 on gambling games (Journal of Laws 2023.227.tj).

(5) The Organizer is the pledgee of the prize within the meaning of Articles 919 - 921 of the Act of April 23, 1964. - Civil Code (Dz.U.2024.1061.tj).

(6) The Organizer declares that the Contest is in no way sponsored, supported or administered by Meta, nor is it affiliated with Meta in any way. The Organizer releases Meta from any and all liability related to the organization and conduct of the Contest.

(7) Each entrant to the Competition declares that:

a) fully releases Meta from any liability related to the Contest,

b) acknowledges and confirms that the Contest is in no way sponsored, endorsed or administered by, and has no association with, Meta.

§2
Objectives of the Competition

1. The main goal of the Contest is to win in the game Counter-Strike 2 (Steam PC version) against a former professional CS player known under the nickname LALACSGO.

2. The games will be quick 1v1 duels on matchmaking maps.

3. Winning more rounds than your opponent guarantees a prize.

§3
Competition Rules

(1) Participation in the Contest is voluntary and free of charge.

2 The competition is open.

3. The Competition is organised in the territory of the Republic of Poland.

4. The Competition is open to all natural persons who are consumers within the meaning of Article 221 of the Civil Code and who are present in the territory of the Republic of Poland.

5. The Competition is open to persons who are at least 18 (eighteen) years old and have at least limited legal capacity within the meaning of the relevant provisions of the Civil Code.

6. The person who entered the Competition is bound by the terms of these Regulations (hereinafter referred to as the "Participant").

7. Minors and persons with limited legal capacity cannot take part in the Competition due to PEGI requirements.

8. The following persons cannot participate in the Competition: employees of the Organizer, as well as members of the closest family of the above-mentioned persons. The closest family members are understood as: spouses, children, parents, siblings, spouses and children of siblings, second-degree relatives and affinities, and persons in an adoption relationship.

9. An employee within the meaning of the Regulations is both a person employed under an employment contract and a person cooperating under a civil law contract (in particular under a contract for specific work, a contract for services).

10. Participation in the Competition and the provision of data related to participation is completely voluntary.

11. Persons who meet the requirements for participation in the Competition described above may enter the Competition.

12. Participants who provide false or incorrect information about themselves or who nominate other people to participate will not receive the prize.

13. Disputes will be resolved by a specially appointed committee consisting of representatives of the Organizer.

14. The competition is organised on Modecom Polska social media channels on Facebook at: https://www.facebook.com/modecom.polska and will be streamed live.

15. The competition will be conducted according to the following schedule:

a) 30/05/2025 – 12:00 – start of streaming the game on Facebook,

b) 2-6 June 2025 – sending prizes to winners (if data is received).

16. The Organizer reserves the right to change the schedule. The Organizer will inform about any changes on an ongoing basis.

§ 4
Conditions for participation in the Competition

1. The condition of participation in the Contest is to win in the game Counter-Strike 2 (Steam PC version) with a former professional CS player known under the nickname LALACSGO.

2. The games will be played as quick 1v1 duels on matchmaking maps.

3. Persons entering the game are informed before it begins what prize they are competing for.

4. A participant may attempt to compete for prizes twice.

§5
Prizes in the Competition

1. The winner may win a maximum of two prizes from the following pool:

- 3 x MODECOM Volcano Lanparty RGB BT keyboard

- 1 x MODECOM Volcano Prometheus gaming headphones white

- 1 x MODECOM Volcano Prometheus gaming headphones black

- 2 x MODECOM Volcano Shinobi 3327 white gaming mouse

- 1 x MODECOM Volcano Shinobi 3360 gaming mouse black

- 1 x MODECOM Volcano Erebus mouse pad

- 1 x MODECOM Volcano Elbrus Hokori mouse pad

2. The value of one prize does not exceed PLN 300.

3. The Organizer will contact the winners of the Competition via private message on Facebook or Steam within 3 days of the end of the Competition.

4. The condition for sending the prize to the winner is that the winner provides the address for sending the prize in the form indicated by the Organizer.

5. If the winner fails to provide a shipping address within 7 days, the prize will be forfeited.

6. The winner may not transfer the right to the prize to a third party.

7. The winner may waive the right to the prize.

8. The Organizer shall not be liable for the inability of the winner to collect the prize due to reasons beyond the control of the Organizer and for which the winner is responsible.

9. The Organizer undertakes to cover the costs associated with obtaining the prize, in accordance with art. 21 sec. 1 item 68 and art. 30 sec. 1 item 2 of the Personal Income Tax Act of 26 July 1991 (Journal of Laws 2024, item 226).

§ 6
Competition Entry

A participant entering the game in 1 on 1 matchmaking mode declares his/her willingness to participate in the Contest. The queue of applications decides about participation.

§7
Participants' rights and obligations

(1) The participant is obliged to respect the rights and obligations under these Regulations.

(2) Any violation of the Rules by a Contest Participant may result in the exclusion of the Contest Participant from the Contest.

(3) It is unacceptable for Participants to take actions that are against the law, contrary to the rules of social coexistence, generally considered morally reprehensible, socially inappropriate or violating the set of rules applicable on the Internet (the so-called Netiquette).

§8
Rights and obligations of the Organizer

(1) The Organizer reserves the right to exclude Participants from the Contest, and in extreme cases to block participation in the Contest of those Participants who violate the provisions of these Regulations, in particular:

a) they conduct activities that are contrary to the law and good customs, and in particular when their conduct harms the interests of third parties,

b) they conduct activities in relation to which there is a reasonable suspicion that they may lead to attempts to circumvent the Rules or the security measures and principles of operation of the Competition.

(2) The Organizer of the Competition shall not be liable for infringement of copyright or personal rights of third parties by the Participants.

(3) The Organizer shall provide all Participants with equal opportunities and fair conditions for participation in the Contest.

§9
Data protection

(1) In relation to the information obligation specified in Article 13(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC - "RODO", the Organizer informs the Contest Participants that the Administrator of the personal data submitted for the purpose of participation in the Contest is Modecom Polska Sp. z o.o.. Personal data will be processed by Modecom Polska Sp. z o.o. for promotional purposes in accordance with the information clause.

(2) The Organizer declares that the personal data collected and processed by the Organizer, as the administrator of personal data, will be used only within the framework of and for the purpose of conducting the Contest, in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws 2019.1781).

§10
Final provisions

(1) The organizer is responsible for the conduct of the Competition and its proper conduct.

(2) The Organizer reserves the right to cancel the Competition in case:

a) when no participant registers for the game,

b) the occurrence of situations beyond the control of the Organizer (e.g. Steam server failure).

(3) Each participant has the right to apply to the Contest Organizer for clarification of the Contest Regulations. Questions should be asked by e-mail to marketing@modecom.eu.

(4) In matters not covered by these Regulations, the provisions of Polish law shall apply.

(5) The Competition Regulations and results will be available to all interested parties on the Organizer's website.

(6) The organizer reserves the right to make changes to the rules and schedule of the competition at any stage. He will notify the changes on his Facebook profile.

(7) Any disputes between the participant and the Organizer shall be resolved by a common court of law having jurisdiction over the seat of the Organizer.
